| Gouldesbrough reserves the
right to only process and ship orders if the following
terms and conditions are accepted with a confirmed agreement
from the purchaser. The purchaser agrees to adhere to
all these company regulations when placing an order
with us.
1. Gouldesbrough assumes no liability
for the use of any products supplied. Liability rests
with the purchaser to use products under the guidance
of a licensed physician.
2. Gouldesbrough takes
no responsibility for confirming the importation requirements
and regulations of the purchaser and the purchaser's
country of origin. All products are shipped: at the
full risk of the purchaser in agreement of holding Gouldesbrough
reserved towards any legal action, that might be brought
against the purchaser if not acting in accordance with
the regulations and importation laws of the destination
country.
3. In the event an order
is detained and confiscated by foreign customs, the
loss rests completely with the purchaser, unless: a
valid medical prescription was submitted to be sent
with shipment a confiscation notification and a proof
of reclaim (forwarded to the Food and Drug Administration
institute responsible for the confiscation) is provided
to Gouldesbrough.
In this case, the purchaser is entitled to a reshipment
of the full order at 50% of the original cost plus shipping
and handling.
4. Gouldesbrough will
fully guarantee delivery only if : a valid medical prescription
is submitted to be sent with shipment.
A traceable and recorded method of shipment (Express
Shipment) is used. The purchaser has provided correct
shipping information.
5. Gouldesbrough takes
no responsibility for lost orders, wrong deliveries
or product damage caused by the Postal Service.
6. If incorrect shipping
information is provided by the purchaser, the order
might be misdelivered and/or returned to sender. Gouldesbrough
takes no responsibility for order losses caused by this
misdelivery or for losses occurring because shipments
are unreturnable due to discreet shipping.
7. Gouldesbrough takes
no responsibility for Money Order/Cashier Check payments
lost in transit from purchaser, unless:
payment is sent by a traceable and recorded mail service.
Copy or purchase receipt of Money Order/Cashier Check
can be provided with shipment receipt.
8. Prices are subjected
to change according to International currency rates
and changes in cost prices without further notice.
9. Availability of products
is subjected to change without further notice.
10. Gouldesbrough takes
no responsibility for dispatchment delays caused by
delivery problems of manufacturer/supplier, or any other
delays caused by a third party. Nor does Gouldesbrough
take responsibility for shipment delays caused by holidays
or the Postal Service.
11. In the event wrong
products are received, the correct products will be
reshipped free of charge, provided the wrong products
are returned unopened and in re-saleable condition.
12. In the event products
arrive damaged due to improper packaging by Gouldesbrough,
products will be reshipped free of charge if a claim
is made and proof of improper packaging is given.
13. Returns are accepted
only if products are proven to be unusable, excluding
section (11).
14. Refunds are accepted
only if products are proven to be unusable. An additional
charge of 15% of the order total (with a minimum of
40 US Dollars) is applied to cover all administration
charges.
15. Order cancellations
after payment has been processed are not accepted.
16. In the event Western
Union payment is used, customer agrees not to make disputes
or claims on payment, for situations as described in
sections (2), (3), (4), (5) and (6), or for any other
reasons that would violate any term and condition in
our Disclaimer. Any charge back, dispute or payment
claim that is attempted in contradiction of this Disclaimer
is considered fraudulent and gives reason for prosecution.
Furthermore, You are giving up Your right to any type
of solution and help from Gouldesbrough to Your order
problem, and Gouldesbrough will refuse to deal with
and give You any assistance in the delivery of Your
order. In addition, any future orders with Gouldesbrough
will be refused completely.
